Court ruling of 1 August 2022. No incidence on operations for the sector’s stakeholders.

Setting up a producer responsibility organization is an ambitious project, marked by both successes and failures. CYCLEVIA is adapting itself to find solutions. Explanation.

Following a court ruling on 1 August 2022, the interim relief judge at the “tribunal administratif de Paris” (Paris Administrative Tribunal) considered that certain clauses in the standard collection-transfer station operator contract were “likely to cause difficulties in relation to competition law”.

This ruling, caused by the individual action of one of the industry's stakeholders, does not put into question CYCLEVIA’s government approval as a producer responsibility organization for the EPR scheme relating to mineral, synthetic and industrial oils and lubricants.

Which measures are affected by the partial suspension?

  • Communication of contracts signed with a collection operator to the producer responsibility organization.

  • Limitation of the geographical collection zone and requirement to possess a transfer station.

  • Minimum storage capacities of transfer stations.

What does this change for you?


From an operational point of view nothing, because the ruling does not affect CYCLEVIA’s obligations or its collection and treatment activities. The producer responsibility organization and the scheme continue to operate normally. Furthermore, holders of waste oils continue to benefit from free collection throughout France by contacting one of the collection-transfer station operators under contract.

The contractual amendments requested are currently being drafted.
